These Terms & Conditions (“Terms”) govern every hire of equipment, with or without operators, from Amirah Equipment Rental (“Amirah”, “we”, “us”), part of World Star Holding, Abu Dhabi, UAE. By requesting a quotation, placing a booking or taking delivery of equipment, the customer (“you”) agrees to these Terms together with the quotation and any signed rental agreement. Where a signed rental agreement conflicts with these Terms, the rental agreement prevails.

7. Loss, damage & insurance

Risk in the Equipment passes to you on delivery and remains with you until collection. You are liable for loss of, or damage to, the Equipment during that time, fair wear and tear excepted, up to its replacement value. Insurance and any damage-waiver arrangements — including who insures the Equipment, third-party liability and operator coverage — are as set out in the rental agreement. You must notify us and the police (where relevant) immediately of any theft, accident or third-party incident.

8. Liability

Nothing in these Terms excludes or limits liability that cannot be excluded under UAE law. Subject to that: (a) we are not liable for indirect or consequential loss, including delay, loss of production, loss of contract or loss of profit; (b) our total liability arising from any rental is limited to the rental charges paid for the Equipment concerned; and (c) you will indemnify us against third-party claims arising from your use of the Equipment, your Site conditions or your breach of these Terms, except to the extent caused by our negligence.

Neither party is liable for failure or delay caused by events beyond its reasonable control — including extreme weather, government action, port or road closures, strikes and utility failures — provided the affected party notifies the other and resumes performance as soon as reasonably possible. Rental charges may be adjusted equitably for prolonged force-majeure stoppages.

12. Governing law & jurisdiction

These Terms and every rental are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi. The courts of Abu Dhabi have exclusive jurisdiction over any dispute that is not resolved amicably.
