These Terms & Conditions (“Terms”) govern every hire of equipment, with or without operators, from Amirah Equipment Rental (“Amirah”, “we”, “us”), part of World Star Holding, Abu Dhabi, UAE. By requesting a quotation, placing a booking or taking delivery of equipment, the customer (“you”) agrees to these Terms together with the quotation and any signed rental agreement. Where a signed rental agreement conflicts with these Terms, the rental agreement prevails.
1. Definitions
- “Equipment” — the machinery, attachments, accessories and consumables listed in the quotation or rental agreement;
- “Rental Period” — the period from delivery (or collection by you) until off-hire is confirmed by Amirah and the Equipment is returned or collected;
- “Site” — the location you designate for delivery and use of the Equipment;
- “Operator” — a certified operator or driver supplied by Amirah with the Equipment.
2. Quotations, bookings & rates
- Quotations are valid for the period stated on them (otherwise 14 days) and are subject to availability at the time of confirmation;
- Rates are quoted for the stated equipment, duration, Site and working pattern; changes to any of these may change the rate;
- Unless stated otherwise, rates exclude VAT, fuel, delivery/collection charges, operator overtime and site-access costs, which are itemised separately;
- A booking is confirmed when we accept it in writing and any required advance payment, security deposit or documentation is received.
3. Delivery, collection & site access
- We deliver and collect across all seven emirates; delivery windows and charges are stated in the quotation;
- You must ensure safe, lawful access and suitable ground conditions for transport, unloading, operation and collection — including permits, road access and space for low-bed trailers where required;
- Waiting time, aborted deliveries and site-caused delays may be charged at our standard rates;
- For controlled facilities (e.g. CICPA/ADNOC sites, ports and free zones) all passes and approvals must be in place before mobilisation; we can arrange CICPA processing where agreed in advance.
4. Operators & use of equipment
- Where an Operator is supplied, they remain our employee but work under your site supervision, safety systems and permits; you are responsible for site inductions and safe working conditions;
- Self-operated Equipment may only be used by your qualified, licensed personnel, within the manufacturer’s ratings and intended use;
- You must not overload, modify, repair, sub-hire, move to another site, or re-locate the Equipment outside the UAE without our written consent;
- You must operate the Equipment in compliance with all applicable UAE laws, HSE regulations and site rules.
5. Rental charges, off-hire & payment
- Rental charges accrue for the whole Rental Period, including days the Equipment is on Site but not used, and public holidays and weekends unless agreed otherwise;
- Off-hire takes effect only when confirmed by Amirah (with an off-hire reference where applicable); until then charges continue;
- Invoices are payable per the payment terms on the quotation or rental agreement; we may charge late-payment costs and suspend or recover Equipment for non-payment;
- Security deposits, where required, are refundable after off-hire inspection, less any amounts properly deducted.
6. Care of equipment, breakdown & maintenance
- You must keep the Equipment secure, protected from weather, theft and misuse, and carry out the daily checks (fluids, greasing, tyre/track condition) described at handover;
- Report any fault, damage or accident immediately and stop using affected Equipment;
- We maintain the Equipment and will repair or replace machines that fail through fair use within a reasonable time; downtime through no fault of yours is credited;
- Damage caused by misuse, overloading, contamination, unqualified operation or neglect — and resulting repairs, recovery and downtime — are at your cost;
- Fuel is your responsibility unless agreed otherwise; Equipment is supplied fuelled as stated at handover and must be returned in like state or refuelling will be charged.
7. Loss, damage & insurance
Risk in the Equipment passes to you on delivery and remains with you until collection. You are liable for loss of, or damage to, the Equipment during that time, fair wear and tear excepted, up to its replacement value. Insurance and any damage-waiver arrangements — including who insures the Equipment, third-party liability and operator coverage — are as set out in the rental agreement. You must notify us and the police (where relevant) immediately of any theft, accident or third-party incident.
8. Liability
Nothing in these Terms excludes or limits liability that cannot be excluded under UAE law. Subject to that: (a) we are not liable for indirect or consequential loss, including delay, loss of production, loss of contract or loss of profit; (b) our total liability arising from any rental is limited to the rental charges paid for the Equipment concerned; and (c) you will indemnify us against third-party claims arising from your use of the Equipment, your Site conditions or your breach of these Terms, except to the extent caused by our negligence.
9. Suspension & termination
- Either party may terminate a rental in accordance with the notice period in the rental agreement;
- We may suspend or terminate immediately, and recover the Equipment, if charges are unpaid when due, the Equipment is at risk, or you breach these Terms materially;
- Termination does not affect charges accrued to the date the Equipment is returned or collected.
10. Force majeure
Neither party is liable for failure or delay caused by events beyond its reasonable control — including extreme weather, government action, port or road closures, strikes and utility failures — provided the affected party notifies the other and resumes performance as soon as reasonably possible. Rental charges may be adjusted equitably for prolonged force-majeure stoppages.
11. General
- Notices — formal notices must be in writing to the addresses on the rental agreement (email accepted);
- Assignment — you may not assign your rights without our written consent;
- Severability — if any provision is held invalid, the remainder continues in force;
- Entire agreement — the rental agreement, quotation and these Terms form the entire agreement for each rental;
- Personal data — we handle personal data as described in our Privacy Policy.
12. Governing law & jurisdiction
These Terms and every rental are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi. The courts of Abu Dhabi have exclusive jurisdiction over any dispute that is not resolved amicably.
